Below is a long blog post about 2016 and some of the things I’ve learned along my journey this year. It has been one helluva ride! A few months ago, I went to see a concert on Halloween with two friends at The Pageant in St Louis. We were all wearing costumes (mine was Jasmine from Aladdin). This isn’t really relevant except for how it led us down memory lane after seeing each other again—and so naturally began chatting over drinks afterwards… As many people will tell you when they’re asked “what do your parents think?” - sometimes our ideas just aren’t good enough yet; however if everyone around thinks otherwise then maybe it does have potential because those same folks usually aren’t wrong either! On October 7th, U.S. District Judge Dolly Gee ruled that the government had violated the rights of hundreds of thousands of children apprehended at the border under its zero-tolerance policy during fiscal year (FY) 2018, which ended on September 30th.[i] The judge’s opinion was issued pursuant to her role as special master appointed by another district court judge following litigation concerning conditions at Dilley Family Residential Center, one of two family detention facilities run by private contractors with funding from Immigration and Custom Enforcement (ICE).[ii] As part of her duties, she also has jurisdiction to review the constitutionality of any new or modified policies implemented while she serves as special master. In July 2019, the Government asked the Court to approve modifications it made to standards governing access to showers, laundry services, recreational time outdoors, visitations, phone calls and other amenities provided to people held in these centers. On August 6th, after reviewing declarations submitted by both parties detailing the changes instituted since June, the Court approved them subject only to certain reporting requirements.[iii] But before issuing her decision granting preliminary approval, Judge Gee requested additional information regarding whether the new procedures would provide detainees enough “contact visits,” defined in relevant regulations as face-to-face meetings between individuals housed separately within the facility. Following several exchanges through motions practice,[iv] the plaintiffs filed supplemental briefing addressing concerns raised by the defendant about what constitutes such contact—an issue central not just to this case but many others involving immigrants in removal proceedings seeking release from detention based on procedural grounds. [v] In late May, a panel of judges from United States Courts of Appeals for the Second Circuit issued a precedential decision holding that ICE had unlawfully failed to afford adequate opportunity for aliens to challenge the legality of their detentions.[vi] Then, on December 5th, Chief Justice John G. Roberts Jr., writing for a five member majority of the Supreme Court, reversed a lower court injunction ordering the Trump Administration to reunite families separated at the southern border in accordance with court orders. While denying relief to the plaintiff parents, he nonetheless
